Creating Identical Wills

WillMaker can help couples make identical wills. By this, we mean that all the provisions in the wills -- such as beneficiaries, alternate beneficiaries, and children's guardians -- are the same. The only difference is that the spouses' names are reversed. For example, if you make a will and name your spouse as your executor, when your spouse makes an identical will, you will be named as your spouse's executor. (You do not have to be legally married to make identical wills.)

Although WillMaker creates your identical will as a mirror of your spouse's will, you can still go through the interview and make whatever changes you want to your own will. So even when the wills end up a little different, many couples find using WillMaker's identical will feature useful for its efficiency.

To make an identical will with WillMaker:

  1. Complete a will for one spouse, naming the second spouse on the marital status screen.
  2. On the document preview screen for that will, click the Duplicate for Spouse button.
  3. On the next screen, click the Duplicate for Spouse button. This will prompt WillMaker to create a second will, duplicating key information from the first will.
  4. Find this new will on the Your Documents menu under the name of the second spouse.
  5. Step through each screen of the new will, reviewing and revising the duplicated information as needed.
